1. Definitions

Service / LinqMaster – The online software and automation service available via www.linqmaster.app, including any related applications, systems, or documentation made available by The Linq Group.

Client / User / You – Any individual or legal entity that registers for, accesses, or uses LinqMaster.

Agreement – The contractual relationship between the Client and The Linq Group B.V. under these Terms & Conditions.

Subscription – The recurring payment plan selected by the Client for using LinqMaster's Services.

Parties – Collectively, The Linq Group B.V. and the Client.

2. Applicability

  • These Terms & Conditions apply to all use of the LinqMaster website, platform, and Services offered by The Linq Group.
  • By creating an account, subscribing, or using the Service, you confirm that you have read, understood, and agreed to these Terms & Conditions.
  • Deviations from these Terms are only valid if explicitly agreed in writing by The Linq Group.
  • The Linq Group reserves the right to amend these Terms at any time. Updated versions will be published on www.linqmaster.app and take effect immediately upon publication unless stated otherwise.

3. Assent & Acceptance

By accessing or using LinqMaster, you agree to be legally bound by this Agreement. If you do not agree, you must immediately discontinue use of the Service.

4. Subscriptions, Payment & Renewal

  • LinqMaster is offered on a subscription basis. By selecting a plan, you agree to pay the fees displayed on our website or otherwise agreed in writing.
  • Subscriptions are billed in advance and automatically renew each month (or other agreed period) unless cancelled prior to renewal.
  • Payment is processed via our authorized payment partners (e.g. Stripe). You authorize The Linq Group to automatically collect recurring payments using the chosen payment method.
  • The Linq Group reserves the right to adjust subscription fees for future billing cycles. You will be notified at least 30 days prior to any price change.
  • All prices are exclusive of VAT and other applicable taxes.
  • In case of non-payment, The Linq Group may suspend or terminate your access to LinqMaster without further notice.

5. Prorated Charges

If you add additional users, accounts, or features during an active billing cycle, a prorated amount may be charged for the remaining portion of that cycle.

6. Free Trial

  • LinqMaster may offer a free trial period for new Clients. The duration and scope of this trial are specified during signup.
  • After the trial period ends, your subscription will automatically convert to a paid plan unless cancelled before the end of the trial.
  • Free trials are limited to one per organization or account.

7. Refund Policy

All payments are final and non-refundable, except where required by Dutch law. Cancellations only take effect at the end of the current billing period.

8. Eligibility & Age Restriction

To use LinqMaster, you must be at least 18 years old and legally capable of entering into binding contracts. By using the Service, you represent and warrant that you meet these requirements.

9. License to Use LinqMaster

  • The Linq Group grants you a limited, non-exclusive, non-transferable, revocable license to access and use LinqMaster in accordance with these Terms.
  • You may not reproduce, resell, sublicense, or exploit any part of the Service without prior written consent.
  • Any breach of these license terms may result in immediate termination of your account.

10. Intellectual Property

  • All intellectual property rights relating to LinqMaster—including the software, databases, designs, trademarks, trade names, and content—remain the exclusive property of The Linq Group B.V. or its licensors.
  • You are prohibited from copying, modifying, or distributing LinqMaster materials, except as explicitly allowed under these Terms.

11. User Obligations

By using LinqMaster, you agree:

  • To provide accurate account and billing information.
  • To maintain the confidentiality of your login credentials.
  • To promptly notify The Linq Group of any unauthorized use or security breach.
  • Not to use LinqMaster for unlawful, fraudulent, or abusive activities.

12. Acceptable Use Policy

You agree not to use LinqMaster to:

  • Violate any applicable law or regulation.
  • Harass, abuse, threaten, or harm others.
  • Send unsolicited or spam messages.
  • Upload malware or engage in data scraping.
  • Attempt to reverse engineer, copy, or interfere with LinqMaster systems.

Violation of this policy may lead to immediate termination of your account.

13. Fair Use Policy

To ensure service quality for all users, LinqMaster operates under a Fair Use Policy. Excessive or abnormal usage that affects system performance may lead to usage limitations, suspension, or additional fees.

14. Data Security & Loss

The Linq Group takes reasonable technical and organizational measures to secure LinqMaster. However, we do not guarantee that the Service will be uninterrupted or free from loss or corruption of data. Use of LinqMaster is at your own risk.

15. Indemnification

You agree to indemnify and hold harmless The Linq Group B.V., its directors, employees, and affiliates from any claims, damages, or expenses (including legal fees) arising from your use or misuse of LinqMaster or your breach of this Agreement.

16. Service Interruptions

The Linq Group may occasionally suspend access to LinqMaster for maintenance, upgrades, or emergencies. We strive to minimize disruption but are not liable for downtime or loss resulting from such interruptions.

17. Term & Termination

  • This Agreement remains effective until terminated by either Party.
  • You may terminate your subscription via your account dashboard at any time; termination takes effect at the end of the current billing period.
  • The Linq Group may suspend or terminate your access immediately if:
    • You breach these Terms,
    • Payment fails or is disputed, or
    • We discontinue the Service.
  • Upon termination, your access will be revoked and any stored data may be deleted after 14 days.

18. Limitation of Liability

  • The Linq Group is not liable for indirect, consequential, or incidental damages, including loss of profits or data.
  • Direct liability is limited to the amount paid by the Client in the six (6) months preceding the event giving rise to the claim.
  • Nothing in these Terms limits liability for intent or gross negligence.

19. Force Majeure

The Linq Group shall not be liable for any failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, internet outages, governmental acts, or strikes.

20. Applicable Law & Jurisdiction

  • These Terms are governed by Dutch law.
  • Any disputes arising from this Agreement will be submitted exclusively to the competent court in Amsterdam, The Netherlands.
  • If any provision of this Agreement is found invalid, the remaining provisions remain fully enforceable.
